1. Agreement to Terms

By accessing our website and using any service offered by Bobby's Motorbike Rental — including motorbike rentals and land tour bookings — you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Requirements

2.1 Motorbike Rental Requirements

To rent a motorbike from us, you must meet the following requirements:

• Age: Must be 18 years of age or older
• Valid Government ID: Philippine government-issued ID required (e.g., National ID, PhilHealth ID, TIN ID, Voter's ID, Postal ID). For Philippine residents: Passports and driver's licenses are NOT accepted. For foreign guests: A valid foreign passport is accepted. See the ID Holding Policy below.
• Physical Capability: Must be physically capable of operating a motorbike safely
• Accommodation Information: Must provide valid accommodation details in Bantayan Island
• Contact Number: Must provide a working phone number with WhatsApp

2.2 Land Tour Requirements

To book a BMR Land Tour, you must meet the following requirements:

• Age: Must be 18 years of age or older
• Contact Number: Must provide a working phone number with WhatsApp
• Accommodation Information: Must provide valid accommodation details in Bantayan Island
• No ID holding required — the motorbike is driven by our licensed guide/driver

3. Booking and Reservations

3.1 Booking Process

• All bookings — for both motorbike rentals and land tours — must be made through our official WhatsApp number: +63 907 352 7234
• Bookings can also be submitted via our online booking forms at booking.html (bike rental) or tour.html (land tour)
• Walk-in rentals are available subject to bike availability
• Reservations are confirmed only after we send a confirmation message via WhatsApp

3.2 Payment Terms

• Final balance is paid in full upon bike collection or tour start (cash only)
• We accept cash (₱ Philippine Pesos) for the final balance on pickup. Reservation deposits are paid via GCash, PayPal, or Bank Transfer as instructed during booking confirmation
• Motorbike rental rates:
  • Honda Click: ₱300 per day
  • Honda Beat: ₱250 per day
  • Yamaha Fazzio: ₱400 per day
• Land Tour rate: ₱840 flat rate for 8 hours (driver, guide, scooter, and helmet included)
• Weekly and monthly rental rates available upon request

3.3 Cancellation Policy

• Cancellations must be made via WhatsApp at least 24 hours before the scheduled pickup time
• No-shows will forfeit any deposit or advance payment (if applicable)
• We reserve the right to cancel or refuse any reservation

4. Booking & Refund Policy

4.1 Reservation Deposit

A deposit is required to confirm and hold your booking. The deposit amount matches the daily rate of your chosen bike and is deducted from your total balance on Day 1 — it is not an extra charge.

• Honda Beat: ₱250 deposit required
• Honda Click: ₱300 deposit required
• Yamaha Fazzio: ₱400 deposit required
• The deposit is applied to your total on Day 1 of your rental
• After submitting your booking form, our team will confirm your reservation via WhatsApp and provide deposit payment instructions

4.2 Cancellation & Refunds

All deposits are non-refundable regardless of when you cancel. Once payment is processed via GCash or PayPal, transaction fees are deducted immediately and cannot be recovered.

• Any cancellation (any time): Deposit is non-refundable
• Same-day cancellation or no-show: Deposit is non-refundable
• Reason: GCash, PayPal, and bank transfer fees are non-recoverable once payment is processed

4.3 Late Returns & Extensions

• Rental Continues Automatically: Your rental starts and ends at the agreed times. If you return late, the rental simply continues — your bike remains yours until you return it to the shop
• No Lock-Outs: We will never cancel your rental or lock you out because you are running late. Ride with peace of mind — just communicate with us if you need more time
• Late Fees: Any extra time beyond your original booking is charged at our standard daily rate (₱250/day for Beat, ₱300/day for Click, ₱400/day for Fazzio), prorated at ₱50/hour for partial days, and settled in cash upon return
• Extensions: Message us on WhatsApp before your return time. Extensions are subject to availability and will be agreed upon in advance

5. Rental Period and Returns

5.1 Rental Duration

• Minimum rental period: 1 day (24 hours from pickup time)
• Late returns beyond your agreed rental period are charged at ₱50/hour (prorated), settled in cash on return
• Extensions must be arranged via WhatsApp before the original return time

5.2 Operating Hours

• Shop Hours: 6:00 AM - 9:00 PM Daily
• Bike pickups and returns must be done within operating hours unless otherwise arranged

6. Use of the Motorbike

6.1 Permitted Use

• The motorbike may only be used on Bantayan Island
• The motorbike must be operated in accordance with all Philippine traffic laws and regulations
• Helmets must be worn at all times while operating the motorbike (provided free with rental)
• The motorbike must not be used for racing, off-road activities, or any illegal purposes

6.2 Prohibited Use

You are strictly prohibited from:

• Allowing anyone other than the registered renter to operate the motorbike
• Using the motorbike while under the influence of alcohol or drugs
• Transporting illegal goods or substances
• Taking the motorbike off Bantayan Island
• Exceeding the passenger capacity of the motorbike
• Making modifications or alterations to the motorbike
• Subleasing or lending the motorbike to others

7. Land Tour Terms

7.1 Tour Package

• The BMR Land Tour is priced at ₱840 flat rate for up to 8 hours
• The tour includes a licensed local driver, guide, scooter, and helmet
• Entrance fees to paid attractions are not included and are the guest's responsibility
• Food, drinks, and personal expenses are not covered by the tour price

7.2 Tour Conduct

• The tour driver operates the scooter at all times — guests must not attempt to ride
• Guests must wear the provided helmet throughout the tour
• Guests must follow the driver's safety instructions at all times
• BMR reserves the right to terminate the tour without refund in case of guest misconduct

7.3 Tour Schedule

• Tours start at the agreed time; delays caused by the guest may reduce the total tour time
• The tour itinerary may be adjusted due to weather, road conditions, or attraction closures
• Extension beyond 8 hours is subject to availability and additional charges agreed upon in advance

8. Liability

8.1 Renter's Liability

As the renter, you are fully responsible for:

• Any damage to the motorbike during the rental period
• All traffic violations and fines incurred during the rental period
• Any injury to yourself or third parties resulting from your use of the motorbike
• Theft or loss of the motorbike due to your negligence

8.2 Damage and Loss

• You must report any damage, accident, or theft immediately via WhatsApp
• Repair costs for damage will be assessed and charged to you
• In case of total loss or theft, you will be liable for the full replacement value of the motorbike
• Police reports must be filed for all accidents involving third parties or theft

9. Condition of Motorbike

9.1 Pre-Rental Inspection

• You must inspect the motorbike before accepting it
• Any existing damage must be documented and acknowledged by both parties
• The renter is responsible for fuel during the entire rental period

9.2 Return Condition

• The motorbike must be returned in the same condition as received
• Excessive dirt or damage may result in cleaning or repair fees

10. Roadside Assistance and Breakdowns

• 24/7 roadside assistance is included with your rental
• Contact us immediately via WhatsApp in case of breakdown or mechanical issues
• Repairs due to normal wear and tear are covered by us
• Repairs due to misuse, negligence, or accidents are the renter's responsibility
• Do not attempt unauthorized repairs

11. Privacy and Data Protection

Your personal information will be collected and used in accordance with our Privacy Policy. By renting from us, you consent to the collection and use of your information as described in the Privacy Policy.

12. Limitation of Liability

To the maximum extent permitted by law:

• Bobby's Motorbike Rental is not liable for any personal injury, death, or property damage arising from your use of the motorbike
• We are not responsible for delays, cancellations, or service interruptions due to circumstances beyond our control
• Our liability is limited to the rental fee paid
• We are not liable for any indirect, consequential, or punitive damages

13. Indemnification

You agree to indemnify, defend, and hold harmless Bobby's Motorbike Rental, its owner (Rogelito G. Cabrera), employees, and agents from any claims, damages, liabilities, costs, or expenses arising from:

• Your use or misuse of the motorbike
• Your violation of these Terms and Conditions
• Your violation of any laws or regulations
• Any injury or damage you cause to third parties

14. Governing Law and Jurisdiction

• These Terms and Conditions are governed by the laws of the Republic of the Philippines
• Any disputes will be resolved in the courts of Cebu, Philippines
• The renter submits to the exclusive jurisdiction of Philippine courts

15. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Updated terms will be posted on our website with a new "Last Updated" date. Continued use of our services after changes constitutes acceptance of the revised terms.

16. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Bobby's Motorbike Rental regarding the rental of motorbikes.
